First Offense
- Six months in jail
- Up to $1,600 in fines (includes mandatory fees and assessments)
- License suspension of 4 months to 6 months
- DUI school for 3 months – to get license returned
- Increased to 6-9 months if blood-alcohol level exceeds .15 to .20%
- AA meetings
- Community service
- Ignition interlock device installed
- Probation of 3 years
There could be increased penalties if:
- You refuse to submit to a blood or breath test
- You are caught speeding over 20 mph on surface streets
- You are caught speeding over 30 mph on highways - 60 days in jail
- A child under 14 years old was in the vehicle
- If you have one or more previous convictions in the last 10 years or 3 or 4 prior convictions, the charge no longer is a misdemeanor but becomes a felony - state prison sentence
If you fail to request a DMV hearing, your license will be suspended.

|
|
Most DUI cases will produce two criminal charges. Even though you can be convicted of both crimes, you can only receive penalties from one. Each charge carries the same penalties.
- Administrative License Suspension – with DMV
- Your attorney should contact the DMV within 10 days of your arrest to schedule a hearing
- If you or your attorney does not contact the DMV in allotted time, you will forfeit your right to a hearing and/or less DMV penalties
- Criminal Prosecution – in a courtroom
- You will be charged with 2 offenses and can be convicted on both
- The penalties are the same for both
DUI charge
Chemical test result – your blood alcohol content was .08% or greater (per se offense)
- If you refused to take the chemical test, there will not be any evidence and you will not be charged with this offense
- Since you did refuse to take this test, your charges will be increased
